Terms of Service

1. Acceptance of Terms

By accessing or using the Clarity Data service, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Service Description

Clarity Data provides access to USAData consumer and income datasets only. We do not provide real estate or business data.

Lead lists are generated on demand from selected filters. Lists are not pulled from a static file. Each order is custom built based on your targeting criteria including geography, income, demographics, household attributes, property signals, residence data, and other available filters.

3. Orders, Billing, and Delivery

Base lead lists are billed per record at the selected volume. Available volumes are 10,000, 25,000, 50,000, and 100,000 records. The minimum order is 10,000 records.

Enrichment is optional and may be selected at checkout. Enrichment is processed after checkout and billed per successful match. The final enrichment charge depends on match rates and is invoiced after delivery.

Delivery is provided via email download link. Without enrichment, lists are delivered immediately after checkout. If enrichment is selected, delivery occurs after processing is complete, typically within 1 to 3 business days.

4. All Sales Final / No Refunds

All sales are final. No refunds.

This policy applies to base lead list purchases and enrichment once submitted for processing. Once an order is placed and delivered, no refunds will be issued for any reason, including but not limited to dissatisfaction with match rates, data quality, or delivery outcomes.

5. No Preview of Records

Users may view filter criteria and estimated match counts before purchase. However, no record-level preview or sample is provided prior to purchase. By placing an order, you acknowledge that you are purchasing based on filter criteria and estimated counts only.

6. Customer Responsibilities and Compliance

You are solely responsible for compliant outreach using purchased lead lists. This includes compliance with the Telephone Consumer Protection Act (TCPA), Do Not Call (DNC) regulations, CAN-SPAM Act, and all other applicable federal, state, and local laws.

You may not use the service or purchased data for unlawful purposes, harassment, spam, or abuse. You may not use data for eligibility determinations in credit, employment, housing, or insurance where such use is restricted by law, including the Fair Credit Reporting Act (FCRA).

7. Data Limitations; No Guarantees

We make no guarantees regarding the accuracy, completeness, reachability, deliverability, or outcomes of data provided. Lead lists are provided as is. Match rates vary based on targeting criteria. Enrichment success rates vary and are not guaranteed.

Data is sourced from third-party providers. While we take reasonable steps to ensure quality, we are not responsible for inaccuracies or outdated information in source data.

8. Intellectual Property

All content, software, and materials provided through the Clarity Data service are the property of Clarity Data, LLC or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any service materials except as explicitly permitted for your internal business use of purchased lead lists.

9. Prohibited Uses

You may not:

• •Resell, redistribute, or sublicense purchased data
• •Use data for FCRA-governed purposes such as credit, employment, housing, or insurance eligibility
• •Engage in harassment, spam, or abusive outreach
• •Attempt to reverse engineer, scrape, or extract data from the service beyond purchased orders
• •Violate any applicable laws or regulations

10. Limitation of Liability

To the maximum extent permitted by law, Clarity Data, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service or purchased data. Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Clarity Data, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the service, violation of these terms, or violation of any law or third-party rights.

12. Changes to Service / Terms

We reserve the right to modify or discontinue the service at any time without notice. We may update these Terms of Service from time to time. Continued use of the service after changes constitutes acceptance of the updated terms.

13. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
